Terms and conditions of sale

Distance sales agreement between PMDS and the customer:

1. RESPONSIBILITY

PMDS assumes no responsibility for disruptions attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, and other similar events that prevent, in whole or in part, the execution of the sales agreement within the agreed timeframe. PMDS shall not be liable to any party for any damages, losses and costs incurred as a result of the failure to perform the sales agreement for the reasons mentioned above, or for any damages, losses and costs incurred as a result of the use or inability to use the products purchased from PMDS the customer is only entitled to a refund of the price paid, excluding any shipping costs. Likewise PMDS is not responsible for any fraudulent or illicit use by third parties of credit cards, checks, or other means of payment when paying for purchased products. PMDS , in fact, is not able to know the buyer's credit card number at any time during the purchase procedure; at the same time PMDS is unable to verify the correct and lawful origin of the credit title delivered by the customer upon receipt of the goods.

2. BUYER'S OBLIGATIONS

Once the online purchase process has been completed, the customer undertakes to print and/or keep a copy of these general terms and conditions, which they will have already reviewed and accepted as a mandatory step in the purchase process, as well as to print the specifications of the product being purchased, in order to fully satisfy the conditions set forth in Articles 52 and 53 of Legislative Decree 206/05. The buyer is strictly prohibited from entering false and/or invented and/or fictitious information in the registration process required to initiate the execution of this sales agreement and any related communications. The personal details and email address must be exclusively their own and not those of third parties.

- PMDS may cancel orders and refund the customer due to pricing errors or for any other reason.

- In the event of a returned product being faulty, stained, missing the tag and/or unsuitable for sale for any reason, PMDS may not refund the customer .

PMDS is not responsible for any customs duties or import taxes.

3. CONTRACTUAL TERMINATION AND EXPRESS TERMINATION CLAUSE

The obligations assumed by the customer in Article 2 above (Obligations of the Buyer), as well as the guarantee of successful payment to be made by the customer, are essential, so by express agreement, the failure by the Customer to fulfill even one of these obligations will result in the automatic termination of the contract pursuant to Article 1456 of the Civil Code, without the need for a judicial ruling, without prejudice to Crush Store's right to take legal action for compensation for further damages.

4. JURISDICTION

Any dispute relating to the application, execution, interpretation, or violation of online sales agreements obtained through the website www.loscrignoancona.it is subject to Italian jurisdiction. These general conditions, unless expressly provided for herein, are governed by the combined provisions of Legislative Decree 50/92 and Legislative Decree 206/05.
